Freedom of Association
Every citizen shall have the right to form associations or unions, subject to any reasonable restrictions imposed by law in the interest of sovereignty or integrity of Pakistan.
Every citizen, not being in the service of Pakistan, shall have the right to form or be a member of a political party, and to participate in the political activities of such a party.
Any political party which works against the sovereignty or integrity of Pakistan can be declared unconstitutional, subject to judicial review by the Supreme Court.
Meaning:
Article 17 protects every citizen’s right to form and join associations, trade unions, or political parties. This is fundamental in a democracy, allowing people to organise, campaign, and represent collective interests.
However, this right is not unlimited. The state may impose reasonable restrictions if an association or political party threatens Pakistan’s sovereignty or integrity. Political parties are also required to function democratically and conduct internal elections in accordance with the law.
Application:
When citizens join a political party, form student unions, or create advocacy groups to promote their views or interests, they are exercising their right under Article 17.
If a political party is found to be promoting anti-state agendas or undermining national integrity—for example, by encouraging sedition or armed conflict—the government can take action against it. However, this action must be backed by evidence and is subject to review by the Supreme Court to prevent abuse of power.
